HR Executive Salary in Mechanical Production: What Does the Minimum Wage Act Say?

geeta m
Dear all my seniors,

Could you please let me know the salary of an HR Executive in a mechanical production company according to the minimum wage act?
KK!HR
The Minimum Wages Act of 1948 does not specify the salary for HR Executives. The Schedule to the Act essentially includes the salaries of blue-collar and white-collar workers in certain specified industries. Executive salaries are determined by companies themselves based on market conditions and the unit's capacity to pay. A good guideline to follow is the 'Region cum Industry' principle. Look for data from the same industry or region for reference.

Dear Geeta, your factory, as stated by you, "mechanical production company," comes under Minimum Wages Applicable for the Engineering Industry. The categorization of wages for the Engineering Industry is based on the skill of the employee, i.e., Highly Skilled, Skilled, Semi-Skilled, and Unskilled. Please follow the Highly Skilled/Skilled employee salary for the HR Executive.

For your ready reference, I am attaching herewith Minimum Wages for 2017-18 for your perusal. When raising a question, you are supposed to provide complete details of your factory. I presume that you are registered under The Factories Act, 1948, in Karnataka.

Dear Shrinath,

What is the logic of equating HR Executives' salary with skilled worker under the Min Wages Act when it does not come under the purview of the Act? Let HR Executives' salary be determined by industry, taking into account market rates, experience, and internal parity.

Dear Mr. Nagarkar,

Please peruse my post wherein I have mentioned about the Minimum Wages applicable for the Engineering Industry. The Employer can pay more than the Minimum Wages, no issues. Even HR Executives come under the purview of the Minimum Wages Act.

For your ready reference, I am attaching herewith the Minimum Wages for S&CE in Karnataka for 2017-18, wherein you can find the Minimum Wages for Assistant Personnel Officer, Assistant Personnel Manager, Personnel Manager, etc.

Dear Srinath,

Thank you for the minimum wage notification and for educating me. If minimum wages are separately prescribed for HR Executives, where is the need for equating with highly skilled workers? Anyway, the salary of a professionally qualified HR professional should be much higher than the minimum wage.

Dear Mr. Nagarkar, please note that minimum wages are not separately prescribed for HR Executives. However, in the minimum wages for S&CE, various designations are provided regarding the applicability of minimum wages, including for HR/Personnel.

The question raised by Miss Geeta was regarding the "HR Executive salary of a mechanical production company according to the minimum wage act." The said industry comes under the category of engineering. Consequently, the applicable engineering industry minimum wages will be the guideline for fixing minimum wages for an HR Executive.

Highly skilled work

"Highly skilled work" means work that calls for a degree of perfection and full competence in the performance of certain tasks, including clerical work acquired through intensive technical or professional training or practical work experience for a certain reasonable period. It also requires a worker to assume full responsibility for the judgment or decision involved in the execution of the tasks.

Skilled work

"Skilled work" means work that involves skill or competence acquired through experience on the job or through training as an apprentice in a technical or vocational institute, and the performance of which calls for initiative and judgment.

Hope this clarification will suffice your requirement.
