Was My Termination Fair? Seeking Advice on Sick Leave and Delayed Payments in Hyderabad

Hello, I was terminated by a small company in Hyderabad without any written warning or notice. I was on a six-month probation when I fell sick and took three days of sick leave, informing HR about my absence each day.

On the third day of my sick leave, they terminated me for being irregular. Sick leaves are considered definite Loss of Pay (LOPs) in this organization. Interestingly, my co-worker was absent for 11 days during their probation and was not terminated. I believe this treatment is very unfair.

Currently, they are refusing to pay me my dues upfront. After a dispute, they agreed to pay within 45 days from the termination date. Should they also be paying me one month's notice amount along with my Full and Final (FNF) settlement for the working days?

In the offer letter, it is stated that they can dismiss me without notice only if I violate any of their policies. However, taking sick leave or being irregular is not mentioned in the company policies within the offer letter.

Your assistance on this matter would be greatly appreciated.

Certainly, it is high-handedness on the part of the organization and cannot be justified. It seems that they may have wanted to let you go, which is why they selectively terminated your employment. However, you can inform them that unless they settle your outstanding payments by the next salary date, you will file a complaint under the Payment of Wages Act 1936, and the repercussions will not be favorable for them.
