Frustrated with Delayed PF Withdrawal: Should I Take Legal Action Against My Former Employer?

Deepakjain007
Hi, I was terminated from my job in May. Since then, I have not been working anywhere. I am trying to withdraw my PF, and my company is not willing to help me. They are taking forever to process the request. It has been more than five months since I left the company, and I have been chasing them for more than two months to get the PF form signed.

Initially, I tried to file a claim online, but I realized half of my PF is missing from the statement. When I talked to my employer, they said the company changed its name, and all employees got new PF accounts. However, my old balance was not transferred to the new account. Now they are suggesting that I should withdraw both PFs separately, and they asked me to fill in some forms, which I did. They said they would get the forms signed and submit them to the PF office. Since then, I have been only waiting with no positive response. I want to take legal action against them for mentally harassing me. Please suggest.

Dear Deepak,

You can simply reach your PF office and give a complaint in writing about the problems and issues faced by you to the PF commissioner's office and take an acknowledgment. Rest assured that they will do the needful. However, you need to do continuous follow-up with the PF office regarding your submitted query or problem, which will expedite the results.

Please let me know if you need any further assistance.

Thank you.
