Struggling to Claim Gratuity After Resignation: What Steps Should I Take Next?

Dear Sir,

I have a query related to gratuity. I am working for Construction Company Pvt. Ltd in Pune and have resigned. My organization has not yet released the payment of gratuity for the last 14 years.

Please advise me on the process of applying for a claim of gratuity, the concerned authority's address, and the required forms. I recently sent Form-1 to my employer via Registered Post after reading discussions on Citehr about gratuity claims, but I have not yet received a reply from my employer.

Dear Anamika,

"Not yet released payment of gratuity since the last 14 years." Has your company been withholding your gratuity for 14 years? You should receive your gratuity for 14 years of service.

The employer should pay gratuity within 1 month from the date of relieving. Approach the jurisdictional "Controlling Authority" or the Assistant Labour Commissioner with all relevant documents for the adjudication of the matter.

As already stated, please wait for 1 month from the date of relieving. Please check with your colleagues/friends for the address of the Labour Department. Ensure you have the following relevant documents:

- Appointment Letter
- Relieving Letter
- Pay Slip containing your Last Drawn Basic+DA+VDA
- Copy of your Application-Form-I for Gratuity
- RPAD Receipt & acknowledgement Card
- Your Establishment Postal Address
