Maternity Benefits for Employees in Non-ESIC Registered Companies: What Are the Options?

An employee whose gross salary is 16000 per month, but the company is not registered under ESIC. What will be the criteria for maternity benefits or leave?

Dear Rupesh,

Consequent to the company not being registered under ESI, the Maternity Benefit Act of 1961 applies to your establishment and to the woman employee in question. She will be eligible for benefits provided therein, i.e., 26 weeks of paid leave. Irrespective of the salary of the woman employee, she is eligible for maternity benefits.
