Maternity Benefit Bill 2017: Does the 50 Employee Rule Apply to Each Division or the Whole Company?

Dear All, Greetings of the day! As per the new Maternity Benefit (Amendment) Bill 2017, the provision on crèche facility (Section 11 A) shall be effective from July 01, 2017. The Maternity Benefit Amendment Act makes the crèche facility mandatory for every establishment employing 50 or more employees. Women employees would be permitted to visit the crèche four times during the day.

I have a query to understand if the number 50 stands for one division or in total for an organization. We are an MNC with two divisions in Gurgaon and Bangalore, having 18 employees at one location and 33 at the other.

As per the quoted text, you have branches at different locations. If you have separate registrations for both offices, then you do not need to have a creche facility under the act.
