Navigating Factory Lease in Haryana: What You Need to Know About Notifications and Documentation

I have a query related to the Factory Act. Please reply point-wise. We are planning to hire a factory on lease in Haryana from 01/04/2018.

Existing Factory Operations

1. The existing factory is already in the manufacturing process. They have their own factory license and will run the factory until 31/03/2018. They have paid off all the employees until 31/03/2018 and sold all machinery to the new company.

New Company Arrangements

2. The new company will have a lease agreement with the existing company for the building on rent. They will purchase all machinery, and the existing employees will be taken on the payroll with fresh joining to run the same manufacturing process. There will be no change in the layout plan, power, or the number of employees as per the existing factory license.

Notification to Factory Wing

3. When do we have to inform the factory wing, one month or 15 days before, that we have taken the factory on lease to start manufacturing from 01/04/2018?

Required Documentation

4. What documents are required if there is no change in the layout plan, power, or the number of employees as per the existing factory license? Will the factory license need to be amended for a change in the factory name or owner? Will the existing building plan suffice?
