Is a Contractor CLRA License Needed for Our Factory Register Compliance?

Kindly confirm if we have taken a contractor CLRA license in the factory. We need to maintain the register under the CLRA Act or as per the Factory Act.

Yes, it is mandatory to maintain the following registers as per the Contractor Labour Regulation and Abolition Act. Also, ensure that you register your company under the act with the labor department and get a registration copy in Form 11. Issue Form 5 to the contractor so that they can obtain a license from the department for the initiation of work, which needs to be renewed every year.

The required registers are as follows:

- Form XXIII: Register of Overtime
- Form XXII: Register of Advances
- Form XXI: Register of Deductions for Damage or Loss
- Form XVIII: Form of Register of Wages-cum-Muster roll
- Form XVII: Register of Wages
- Form XVI: Muster Roll
- Form XIII: Register of Workmen Employed by Contractor
- Form XII: Register of Contractors

Thanks for the update. However, I have a question - do I need to maintain the factory act register when I have obtained a contractor license?

All the registers required as per the Factories Act need to be maintained unless you have a computerized records system supported by communication provided to the factories and labor department.

I think you don't understand my point. I want to know if I am a contractor in a factory and I take a CLRA license, do I need to maintain the CLRA register or the Factory Act register?

You need to maintain them as per the Contract Labour Regulation and Abolition Act. The person in charge in the factory has to maintain the factory's register as it is their duty, not yours.

Hi,
As per the law, the Factory Act is the superior act against CLRA, S&E. Therefore, the contractor must also maintain the register under the Factory Act if the work is carried out in a factory. Section 119 of the Factory Act clearly states that if, for the time being, the CLRA Act is applicable, the Factory register must be maintained by the contractor.
