How Should Earned, Casual, and Sick Leaves Be Recorded in the Muster Roll? Plus, Bonus Calculation Confusion

I am Ramesh Katkojvala, working as an HR professional for a steel tube manufacturing unit in Telangana state. Sir, my query is regarding the number of earned leaves, casual leaves, and sick leaves that need to be reflected in the muster roll for the accounting year or calendar year. Additionally, I would like to know if the bonus will be calculated based on the basic salary or gross salary.

Could you please clarify these queries for me?

The Factory Act only pertains to Earned Leaves, providing 1 leave for every 20 days worked. Apart from this, the decision to grant Casual Leave (CL) or Sick Leave (SL) is entirely at the discretion of the management. Bonuses are to be paid based on Basic/DA.

Hi K Ramesh, our labor laws differ state-wise as the state government is authorized by central laws to make provisions as per local legislation and regional requirements. Take the example of "THE PUNJAB INDUSTRIAL ESTABLISHMENTS (NATIONAL AND FESTIVAL HOLIDAYS AND CASUAL AND SICK LEAVE) ACT 1965." Here, it specifically describes paid holidays for three national holidays - 26th January for Republic Day, 15th August for Independence Day, and 2nd October for Gandhi Jayanti, along with five festival holidays every year. It also provides for seven casual leaves and seven sick leaves in a calendar year.

The act is applicable in Haryana state as well. Such provisions are commonly accepted across the industry throughout the country; however, they are not compulsory for implementation. Therefore, one earned leave for 20 days as per the factories act and 7 SL + 7 CL with around 8 regional holidays is a common practice that is applicable.

Dear Ramesh,

Please go through the Factories Act, 1948 (Central) and the relevant State Factories Rules thoroughly before raising your query. Leave is credited on a Calendar Year basis, i.e., from January 1st to December 31st.

Similarly, you have to go through The Payment of Bonus Act, 1965 (Central) and the relevant State The Payment of Bonus Rules. Bonus is paid on a Financial Year basis, i.e., from April 1st to March 31st.
