A worker is eligible to be paid for a National/Festival Holiday only if he is not absent either the day before or after that particular holiday. Is it right? If so, could anyone get me the reference, please.
Whether to apply the sandwich rule or not will depend on your company's leave policy. National holidays are generally paid for all on-roll employees; however, for contract employees, it may be disputed in the case of a continuing leave period.
Thanks for your reply. It says that it depends upon the internal leave policy of a company. Please clarify whether such leave policies of a company are backed by any statutory law. If so, please help me by giving reference to such labor law. Don't we have any statutory provisions?
Please peruse the relevant National & Festival Holidays Act and Rules. Hypothetical questions cannot be answered specifically.
