Seasonal Factory Injuries: Who Covers Medical Costs When ESI Doesn't Apply?

Hi,

As the ESI Act of 1948 is not applicable to seasonal factories, what happens if an employee of such a factory gets injured during working hours? Who would be liable in this situation? Please clarify.
