Confused About Which Act Applies to Our Office and Factory Setup? Let's Discuss!

The reply will depend on various factors:

Are the directors/partners the same or common? What is the nature of the business of ABC? Is it related to the products or services of XYZ? If XYZ owns the factory premises, then is there a rent agreement between both?

Even if you engage one employee on a contract, your staff count will legally be 20. Please keep this in mind.

Dear All,

We have our office at the factory premises, whereas the factory is registered in the name of XYZ firm, and my office is registered in the name of ABC. My question is, currently, under which act do we fall, and what is the number of our office staff? Our staff strength is currently 19.

Thank you.

You fall under the Factories Act. The definition of a factory includes all premises in the 'precincts' as a factory. Hence, ABC is a factory premise. If you have a factory license with only XYZ manpower, get it amended to include the manpower of ABC in it.
