Factory Act or Shop and Establishment Act - factory and office registered with different names

The reply will depend on various factors:
Are the directors / partners same or common?
What is nature of business of ABC? Is it related to products or services of XYZ?
If XYZ owns the factory premises then is there a rent agreement between both?

Even if you engage one employee on contract your strength will legally be 20, please bear this in mind.

Dear All, We have our office at factory premises where as the factory is registered in the name of XYZ firm and my office is registered in the name of ABC - question is right now we falls under which act and number of our strength is 19 of office staff?

You fall under the Factories Act. Definition of factory included all premises in the 'precincts' as factory. Hence ABC is factory premise. If you have factory license with only XYZ manpower get it amended to include manpower of ABC in it.
