Is Employee Verification Legally Supported? Seeking Clarity on Rules and Notifications

Does employee verification have legal support, any notification pertaining to that, or any predefined parameters in lieu of the same? If anybody is aware, I would appreciate a revert.

There is no legal sanctity for Employee Verification, but this can help a potential/existing employer to find:

1. Loyalty/integrity of an employee.
2. Discrepancies between his words and reality.
3. Any hidden information that could be revealed during verification.
4. Positive/negative remarks from a previous employer that may strengthen the findings.

Dear Umesh, there is no legal sanctity as specified by Mr. Prashant Ingawale. However, depending on the severity of the work and the profile, you must go for it. Employee verification includes: previous employment verification, education verification, background verification (police/court), etc. This may be really helpful to understand the background against what he quoted in the resume or at the time of the interview.

Also, in today’s digitally equipped world, it is very important to understand and identify the genuine documents produced by the shortlisted candidate/employee.

There is no legal provision for conducting a background check. However, most companies include it in their appointment or offer letter. Additionally, many companies also obtain authorization from employees for the background check. In the past, I have received such authorization as we do not provide any information without this approval.
