Company does not allow maternity leave benefit of 26 weeks - which is allowed as per latest amendment

Hello Experts,
My wife is working in Private Limited company of website development at Ahmedabad, Gujarat. She has been working in this company for last 4.7 years.
At present, as per her company's maternity leave policy, she can avail three months leaves with basic pay.
As per my knowledge, From 1st April,2017 maternity leaves has been extended to 26 weeks, in which 8 weeks pre-delivery and 18 weeks post-delivery with full pay and this rule apply to all organization with 50+ employees.
Please provide me your valuable advice and further knowledge for maternity leaves with necessary documents. So that I can bring on company's notice very well and take necessary actions for the same.

As per prevailing law and order, no company is allowed to make own Maternity Leave Policy. Companies should give Maternity Benefits to eligible employees either as per ESI Act & Rules or Maternity Benefit Act & Rules. In both the cases, it is revised to 26 weeks (earlier it was 12 weeks) of paid leave.
