Is It Legal to Lose Holiday Pay for Taking Unpaid Leave? Seeking Insights on Company Policies

Dear professional colleagues, I request you to kindly share information on the following query: If an employee works less than 20 days in any particular month, will he/she lose the weekly holiday and festival holiday benefits for that month? In the present case, during September 2017, out of 24 working days, the employee took 4 days of leave without pay, reducing her working days to 20. Consequently, she will lose the Sunday benefit and festival holiday benefit. Therefore, due to having taken 4 days of leave without pay, she has lost salary for 10 days (4 days of LOP + 4 Sundays + 2 Dasara festival holidays).

Now, my question is whether such a leave policy adopted in any organization has legal sanctity and is in compliance with applicable laws and rules. Are there any organizations following such a leave policy? Please share some knowledge on this so that it will be helpful for future guidance and we can strive for the reversal of such a punitive policy.

Entitlement of a weekly day off is after 6 or 5 consecutive days of working, as the case may be. The number of working days in a month has nothing to do with the allocation of the weekly day off. Please review the information provided regarding this matter.
