Does an Employer Need to Pay Bonuses During Maternity or Sick Leave Under ESIC?

Need clarity on whether the employer has to pay a bonus for the period when the employee is on leave (maternity leave or sick leave) under ESIC.

It depends upon the employer. Otherwise, it is covered under ESIC.

Dear Kumarvel,

Bonus under The Payment of Bonus Act, 1965 need not be paid when an employee is under ML under ESI. Bonus should be paid based on the actual earnings/salary earned during the financial year.
