Whether the Labour Welfare Fund is applicable to employees who have left during the year, i.e., from January to November, and whether it is also applicable to all employees in Tamil Nadu.
Please refer to Rule 12(1) of the TN Labour Welfare Fund Rules, 1973. According to this rule, the employer shall recover the contribution not only from the employees who are in the service of the establishment as of 31st December of the year but also from the employees who were discharged, dismissed, or have resigned during the year if they have worked for not less than 30 days during the year.
It is compulsory if an employee works for 30 days in a year with an employer.
