ESIC Coverage Confusion: Am I Still Eligible with Most Employees Above the Wage Ceiling?

Dear All,

My company's strength has increased from 18 to 46 in one month, but the gross wages of 37 employees are above the ESIC ceiling of 21k. Am I still eligible for coverage under the ESIC scheme?

Hi, applicable only when the number of employees earning less than 21,000 per month is 20 or more.

Yes. The act is applicable to establishments engaging 10 or more persons. It does not specify that such employees should be drawing less than ESI wages. Hence, the Act is applicable to your company.
