Seeking Case Law: Has PF Interest Ever Been Waived Due to Portal Errors?

Hi Seniors,

Please share the case law where PF interest and damages were waived off due to a technical error from the PF department (the new unified portal could not process the ECR). Proper documentation was done with the department.

PF Damages and Interest Enquiry

The PF Official cannot levy damages and interest unless holding an enquiry under section 7A. If the code numbers are not allotted to the firm/organization, they cannot levy damages or fines as these are related to the PF organization's efficiency and fall under their work ethics. Also, regarding your question, when the portal of the PF is at fault, they cannot impose interest and damages on the employer. This can be resolved amicably through representations by the organization in case such faults appear.
