Stuck with PF Withdrawal? How to Proceed When Your Employer Won't Sign the Form

diksha56masih@gmail.com
What can be done to withdraw the PF account when the employer is not ready to sign the PF form as the employee left without any notice?

To withdraw the PF account when the employer is unwilling to sign the form due to the employee's sudden departure without notice, there are a few steps that can be taken. Firstly, the employee can reach out to the PF office directly and explain the situation. They may be able to provide guidance on alternative steps that can be taken to process the withdrawal without the employer's signature. Additionally, it could be beneficial to seek assistance from an HR professional or legal advisor who can offer further support and advice on how to proceed in this situation. It's essential to gather any relevant documentation or proof of employment to support the withdrawal request and ensure a smoother process.

Dear Diksha,

You can directly approach the PF office to file a PF withdrawal. Once you do so, it will automatically be taken care of by the PF authorities.

Thank you.

Thank you very much for getting back to me, Mr. Manoj.

So, is there no need for the employer's signature? Also, which documents do I need to bring with me? Could you please explain the procedure to me?

Regards,

Employer sign is not required at all if your KYC's are updated. Then you can fill Aadhar-based composite claim form for withdrawal. You need to carry your Aadhar card copy, PAN card copy, and cancelled cheque with the filled form.

If KYC is not updated, then you need to fill the non-Aadhar form. For that, employer signature is compulsory, but you can still submit that form to the PF office. Later on, they will send it to the respective employer, and it will be surely signed by the employer.

EPF withdrawal without employer signature

There are three types of methods through which an employee can withdraw the PF amount. The first two are very easy to use and hassle-free because you are secure whether your employer cooperates or not. The second method is slightly different and risky as well, with a probability of rejection being another point in this method.

First Method: AADHAR linked EPF withdrawal (Offline)

For AADHAR-linked withdrawal, the following things you should know:

- The Aadhar of the employee should be verified by the employer.
- Updated UAN database with your details such as Aadhar number and bank account.
- You should have your UAN number, which is allotted by the EPFO.

*During the withdrawal process, they will not ask you about your KYC details or your identity proof. The process of verification will be done by the Aadhar data, and the money will be deposited into the account authenticated by the employer.

Steps:

1. Fill the Aadhar composite form as per the given instructions.
2. Attach a cancelled cheque (same as your UAN database).
3. Aadhar copy/Pan card copy.
4. Go to your nearest EPF regional office and submit all documents.

Second Method: AADHAR linked EPF withdrawal (Online)

A new facility has been launched in the employee’s Member Interface of the Unified Portal for employees/members (https://unifiedportal-mem.epfindia.g...mberinterface/) to submit online claims based on the Composite Claim Form (Aadhaar).

- For online submission of a claim, members are required to complete e-KYC on the Unified Portal for submitting their claims through online mode, and such claims will be available in the field office application software for processing without routing the same through their employers.
- For online submission of claim forms, the facility would be available only to those PF members who have seeded their KYC’s (Aadhaar number and bank details) against their UAN, which have further been verified digitally by the employer and also from the UID database, and service details are available on the Unified Portal.
- EPFO has also instructed that priority needs to be given to online claims. All EPF field offices are advised to settle online claims within 5 days.

Third Method: EPF withdrawal without Aadhar number

This method is rarely used nowadays. This process is different from the previous ones as you have to verify yourself. Since the employer doesn't verify, you have to attest the withdrawal form from other authorities like a gazetted officer, bank manager, or designated member of the EPFO.

For non-AADHAR linked withdrawal, the following things you should know:

- Stamp as well as signature is mandatory on every single page of the application.
- Write a letter stating the reason for the direct application for EPF withdrawal.
- Attach an affidavit on a Rs.100 stamp paper just for security purposes.
- Attach service proof as well as your identity and address proof.
- Fill the Non-Aadhar composite form as per the given instructions.
- Cancelled cheque/passbook.
- Aadhar copy/Pan card copy.
- Date of birth proof - School Leaving Certificate (SLC).
- Go to your nearest EPF regional office and submit all documents.

I hope this will be helpful for you.

Regards, Amit
