How Should I Handle Paternity and Marriage Leave in a 16-Day Leave Policy?

Dear All,

I have recently joined a Construction company in Pune, and I need to formulate the leave policy. This company only offers 16 leaves, so I need to divide them into CL, SL, and PL.

My question is, do we provide extra leaves for Paternity leave in addition to the 16 leaves? What is the Paternity Leave policy?

Similarly, regarding an employee's (self) marriage, should we grant extra leaves on top of the 16 leaves?

I kindly request your assistance on these matters.

Shops Act and Leave Policy

The Shops Act will be applicable to your company. As per the Shops Act, 21 days of leave are mentioned. There is no mention of CL, SL, or PL in the Act. Therefore, you should not use these labels for leave even if the total days exceed 21. The bill for changes in leave and other aspects has not been gazetted yet. So, stick to 21 days of annual leave for now.

Paternity Leave and Marriage Leave

Paternity leave and marriage leave are initiatives from your end. You can decide the duration of leave for these two categories. Initially, both types of leave can be referred to as 'provisional leave'.

For paternity leave, you can finalize the leave once the employee submits a copy of the child's birth certificate within, let's say, a month of the birth. It should be noted that only two instances of such leave will be permitted for an employee.

Regarding leave for self-marriage, the applicant can attach the marriage invitation card if available. The leave can be approved if the employee submits a copy of the marriage certificate within, let's say, a month of the marriage. It should be mentioned that only one instance of such leave will be allowed for an employee.
