Can Someone Other Than the Owner Sign Form-V Under the Contract Labour Act? Seeking Advice from HR Peers

Respected seniors,

This is Ramu working as DM-HR in the manufacturing sector at Vijayawada. My query is whether the Form-V under the Contract Labour Act can be issued by an authorized person if management (Owner) gives authorization to someone else, or only the employer (owner/occupier) has to sign on Form-V? My point of view is that an authorized person means someone other than the Occupier or Manager as per the Factories Act. Kindly give your valuable suggestions on this.

Dear Ramu,

Yes, the person in the capacity of manager is authorized to sign Form 5, but only when it has been authorized by the employer through proper notice.

An Occupier or Manager can sign Form-V automatically. In addition to the above, can the management authorize another person through an authorization letter to notify the relevant authorities?

The person having the controlling authority and who has been authorized by the Occupier or Manager to do so can issue V on behalf of the organization.

My point of view is whether an Occupier or Manager can give authorization to another person on behalf of the management, other than these two individuals. If the management is providing an authorization letter to government authorities, is it acceptable?
