Understanding Government Leave Policies for Private Sector in India: What HR Needs to Know

Is there any government leave policy for the private sector in India? As I am an HR management for the startup company, I am being told to prepare or show government policy to establish a minimum number of leaves in our leave policy.

Private companies don't offer all the holidays marked by the government. Although they provide 8 to 10 paid holidays such as Diwali, Holi, etc. I have seen companies providing compulsory holidays, i.e., 8 paid holidays.

Are you referring to festivals/holidays or leave policy? If you are inquiring about leave policies, please refer to your state's Shops and Establishments Act or Factories Act if you are registered under the Factories Act.

Please go through all labor laws applicable to your startup industry before drafting any policy. What leave policy have you drafted? What is the basis for the policy? What are the relevant laws applicable?

If you are an office, the Shops and Establishment Act will apply, and therefore the leave mentioned therein will be applicable. If you are a manufacturing startup, you have to allow one day of leave for every 20 days that he or she works.
