Can a Nominee Claim EDLI Benefits if the Employee Left 3 Months Ago? Seeking Guidance

Dear Members,

If an employee who left the service 3 months ago has now passed away, could his nominee claim EDLI benefits under EPF and Miscellaneous Provision Act since the member was no longer in insurable employment for the last 3 months? If yes, please provide a suitable reference for it.

EDLI Benefit is payable only for death while in service. In the present case, death has taken place subsequent to leaving service. Consequently, eligible for withdrawal of PF & EPS pension for spouse, children, or parents as applicable.

EDLI is a benefit under the PF; it has nothing to do with the ESI Act.
