Dear Sudhanshu,

Please note that if your dad was working for a small shop and receiving a salary in cash without any written proof, then it would be very difficult to prove continuous employment. Additionally, if the shop has less than 20 employees, it may not be covered under ESIC or PF.

Thank you.

Thanks, Mr. Kamble, for your valuable reply.

So please suggest what I can do for my father because he has no extra earning in the future. Please guide me in a legal way. I have some witnesses in the market; are they helpful or not?

I agree with you that below 20 staff, PF & ESIC are not applicable. My father has worked with the same owner for more than 30 years, so is there any act for this situation?

Please advise for a better answer. Thank you for your reply.
