Are Labor Laws Relevant for a Small E-learning Startup in Pune? Seeking Clarity!

Hi, I am an HR professional at an E-learning company based in Pune. We currently have a staff of 25 employees and are planning to gradually increase this number. Our company is a startup and is approximately 2 years old. I am seeking clarification on whether labor laws are applicable to this type of setup. If they are, could you please specify which laws apply? If not, I would appreciate understanding the reason for their inapplicability. Your guidance on this matter would be greatly appreciated.

Since yours is an ITES organization, it is covered by the State's Shops and Establishments Act. By virtue of your current number of employees and the likelihood of a gradual increase in the future, all allied labor laws such as the Industrial Employment (Standing Orders) Act, 1946, the Industrial Disputes Act, 1947, the Minimum Wages Act, 1948, the Maternity Benefit Act, 1961, the Payment of Bonus Act, 1965, the Payment of Gratuity Act, 1972, and the Equal Remuneration Act, 1976 would become applicable too. Since the numerical strength of employees is an important criterion for the application of certain Acts mentioned above, it is advisable to review the relevant rules framed by your State for clarification.
