Availing of Compensatory Leave - would sandwich rule apply?

Dear All,
Please reply : Ram worked on two Sunday on that same month. That means he is eligible for 2 compensatory leaves. As per our Company rules any employee who has earned any Comp. Leave, can avail the same within the financial year. Now my question is that if the employee takes leave on 14 and 16 August, 2017, will the intervening Holiday on 15 August comes under the leave. Please reply.

Ideally you can allow him to for that leave and you should not be considering 15 August as leave. As you are giving comp off for work on weekly off thus you can consider the same as working and allow him for the same.

The person has taken a comp off and not any other leave. The Comp. off stands alone, this is not merged with any other leave. So, the day's will be stand alone, and therefore it will not be accounted as straight leave. and no 15th August will be a Holiday and not a leave as the 14th and 16th are not leaves but adjustment against comp offs.

14th and 16th are in lieu of working on a holiday. Then why to club 15th aug and count them as 3 days leaves? It shouldn't be done!

Dear friend,
It would be wrong to equate 'leave' with 'compensatory off' as both are different. CO is legally entitled for having worked on weekly off and can certainly be sandwiched with paid holiday ,here it is National holiday. Leave rules differ from org to org and may or may not permit sandwiching paid holiday with any type of leave.
