Are International Employees Included in EPS? Seeking Clarification and Official Circular

Dear Friends,

I have a little confusion I want to know if International Employees are covered or not in EPS. As per my knowledge, any employee who becomes a member from 1st September 2014 will not be covered in EPS. However, I don't have a copy of any circular; I only found this information on the internet.

So, please, if someone has the circular, kindly share it with me.

The amendment was only for domestic employees; rules remain the same for international workers as before.

1) International workers to get PF advances or not (if yes or not). If yes, which para & scheme (EPF). If no, which para & scheme (EPF).

2) If an international worker wants to settle the amount through the employer, then what documents need to be submitted to the EPF office.

Dear Shrikant ji, you may be right, and all of us are right, but without documents, how can we justify the same? If you have read my post, I have used the word "confusion" because I don't have a legal document for the same. I have searched a lot but received only the EY Notification, and in the EPFO E return tool data entry detail, PF is asking for any notification or signed documents. As you are asking about the Gazette Notification, please help me search for it as I have put in a lot of effort, but I have found no result.

Dear Shrikant Ji,

Thank you, but you haven't read my thread properly before replying. I know every international employee has to pay PS on gross salary, effective from 1st Nov 2008, as mentioned in the notification issued on 7th Jan 2009. However, I am speaking about the notification effective from 1st September 2014.

Dear All,

Please find EPS Circular dated 29/08/2014, according to which new EPF members whose entry-level EPF wages are more than Rs15,000/- cannot become members of EPS. However, those who are already EPF members in their previous employment and have not withdrawn PF amount can continue to be members of EPS, irrespective of their EPF wages being more than Rs15,000/-.

Here is the EPFO notification confirming that any employee joining an establishment on or after 01.09.2014 is not entitled to join the EPS scheme.

Dear Seniors,

With respect to this notification from the PF office, one query has been raised by our external auditor. If an employee's basic salary is more than 15,000/- and he is a fresh PF member, is it compulsory to make him an EPS member and allocate his funds to PF and EPS? Suppose an employee's basic salary is more than 15,000/- at the time of becoming a PF member, and we restricted his contribution up to 15,000/-. In such a case, do we need to pay EPS also? The external auditor is saying that since we have restricted the PF contribution to Rs. 15,000, we need to pay for his pension also.

Please advise on the above-mentioned query.
