Gratuity in case of employee death - less than one year service?

This Ramu working as DM-HR at Vijayawada. I need a clarification on gratuity payment on death case. One of our employee just completed 4 months service has died during working hours due to his personal health problem (Heart attack). Whether our company has to pay Gratuity for life cover even if less than one year service? Kindly advise me on this issue

Dear Mr ramu, the question of payment of gratuity to an Employee who has put in 4 Months service does not arise.

To be eligible to receive gratuity employee should complete one year of service. Since the employee has completed 4 months of service, s/he will not be entitled to receive gratuity.
