Need Help Crafting a Leave Policy for IT Company Under Mumbai Shops & Establishment Act?

convergentinfotech
Dear All,

I have recently joined an IT company. We are involved in software development. However, we do not have a leave policy in place yet. The management has tasked me with implementing one. Could you all please guide me on the permissible number of CL, SL, and EL/PL that an IT company can provide according to the Mumbai Shops & Establishment Act?

Thank you.

Dear member,

Please note that it is not "Mumbai Shops & Establishment Act." Please go through the Maharashtra Shops & Commercial Establishments Act & Rules in detail before implementing applicable leaves as provided under the relevant Act.

CL should not exceed 12 days. Employees are entitled to 1 day of EL for every 20 days worked. If ESIC is applicable, there is no need for SL; otherwise, employees are entitled to 10 days of SL.

Hi, I am working as an HR in an IT company. I have been asked to suggest some leave policy improvements. We have 12 casual leaves (CL) and 10 festival leaves, of which 3 are optional. The current policy states that if the leave is more than 2 days, it will be considered as 1 day = 2 leave without pay (LWP), which has made our employees unhappy. I recently joined this company; could you help me with suggestions on how to make the necessary changes? Thanks.

Regards, Pooja Mishra
