Latest EDLI & Admin Charges Waiver On EPF

susmit1985
Hello,
I am hereby putinga query regarding EDLI & Admin amount to be calculated for EPF.
Previously it was 1.36% as per norms:
In details:
.85%
.50%
.01% or 200/- fixed.
Now as per the latest amendment, they said .85% is decreased to .65%
& as per Central Govt Notice vide S.O 828 (E) dated 15.3.2017 has determined that no sum shall be payable by the Employer towards administration of the Employee Deposit Link- Insurance Scheme 1976.
Can you please clarify the above ?
Is it mean that an EMployer have to consider only .65% of Basic or 1.15% (.65%+.50%) of Basic.
Kindly Clarify.

Hi Expert,
Quarry:
Since 1990, our company was exempted from EDLI, U/P 28 (7). Refer to EPFO internal office order dated 6/2/2017,concern refused to grant further exemption. From Feb.17 onward we started deposit EDLI amount in in A/c 21 to EPFO. During this period ,one of our employee expired on 15/6/2017 & he was continuous member of EPF ( 1992- Jan 17 with LIC & Feb 17 to till death with EPFO). Now EPFO is not agree to pay 100% benifit & plea that you engaged with us in Feb 17 & diseased is not completed one year with EDLI contribution ,So 100 benifit can not be paid to disease.

Principally EPFO should not reject your claim as you were paying insurance premium regularly to LIC since 1990 based on exemption granted by EPFO.
There is continuity of employment & Employees Deposit Linked Insurance Premium payment thru LIC since 1990 and based on EPFO directive only you have changed the plan and started depositing the premium with EPFO from Feb. 2017. Therefore the PF Authorities stand that the deceased member contribution is for only 4 1/2 month is baseless and absolutely wrong.
You can represent you case to the Regional P.F. Commissioner with all supporting documents with a copy to the Central PF Commissioner, New Delhi. Your case will be definitely heard and deceased member will get compensation.
Pls prepare brief of the case and take advise from the lawyer for proper representation.

Suresh

Chetan,
Your query is not clear, however, I submit as under:
EPF salary/wages ceiling is Rs.15,000/-, however company may allow to deduct PF on your actual earned Basic salary with joint consent. (employee&employer).
Family Pension & DLIS wage ceiling is maximum of Rs.15,000 or actual earned Basic salary, whichever is higher.
