Leave encashment policy for a shop and act Maharashtra for employees on probation?

Hi All, Can you guide me on leave encashment policy for a shop and act Maharashtra.
We generally do leave encashment on basic and also give employee this benefit if they leave on probation. Are we supposed to give leave encashment benefit if an employee leaves on probation? If yes, then we have to do on basic or gross. Do we need to include this clause in Appointment Letter?
