Can an Employee Withdraw PF While Suspended Pending Enquiry? Seeking Advice from HR Peers

Rahul@delux
Dear All,

One worker from my company is suspended through "suspension pending enquiry," and now he wants to withdraw his PF. Would he be eligible for the same?

Thank you.

Is he paid subsistence allowance during the period of suspension?

Hi there,

Regarding your question, I'd like to clarify that the company's policy states that employees under suspension are not eligible to receive any allowances, including subsistence allowance. Suspended employees are placed on unpaid leave until the investigation or disciplinary process is completed. If you have any further queries or need more information, feel free to ask.

Thank you.

He is not eligible for withdrawal of EPF during the suspension period wherein he is receiving a subsistence allowance.

Rahul,

Suspension pending inquiry means he is continued to be in your roles; hence, he is not eligible to withdraw the PF amount. Hope you are obtaining acquaintance for the subsistence allowance and filing. Till he resigns or gets terminated by the organization, he continues to be in employment, and even after that, he needs to wait for 2 months from the date of exit from the employment; hence, simply deny.

He can take a PF loan if eligible but cannot claim the full PF amount as he is still in employment.
