ESIC Contributions: Do We Need to File Returns Starting January 2017 After Crossing 10 Employees?

Our company registered on 30th June 2017, but the ESIC limit of 10 employees was crossed on 2nd January 2017. Only 1 employee's salary is below the 21000 limit. We have deposited contributions for June 2017. Do we have to deposit contributions and file returns from January 2017?

The salary ceiling of 21000 is for making payment exclusion from ESIC. However, the ESIC act becomes applicable immediately when the "total" number of employees exceeds ten. It does not matter whether they are drawing 21000+ or not. For the applicability of the act, all employees are counted for registration, and contribution is payable for only those employees who are below the ceiling limit. The rest are excluded.

With effect from 01 July 2017, contributions must be deposited by the 15th of every month.

Currently, we have 15 employees, and we are registered under ESIC. All employees' salaries are above 22000. How can I file a NIL return in the ESIC Portal?

As the total number of employees reached 10 in January 2017, you should start the enrollment process immediately. Once you receive the coverage letter, you can proceed as instructed in the letter.

We have already registered in ESIC on 30th June 2017, and the date of registration in the ESIC letter is also 30th June. In the registration letter, we mentioned 02/01/2017 as the date on which the limit of 10 employees was exceeded. There is nothing specific written in the letter about the period for which you need to file returns. So please guide me.

Contribution payable from the date of exceeding employment strength, i.e., Jan 17.
