Maternity Benefits Without ESIC Registration: What Can Employees Expect?

If the employer is not registered in ESIC, what benefits will their employees receive under the Maternity Act?

Dear Anonymous,

Benefits under the Maternity Act have to be provided to female employees as per the Maternity Benefit Act, if ESIC is not applicable to the organization or if the female employee is drawing wages more than the ceiling limit of ESIC.

If the Maternity Benefit Act of 1961 is applicable to your establishment, only then is a woman employee eligible to claim the benefits provided therein.

The Maternity Benefits Act applies to all organizations in the country where 10 or more employees are employed. The act applies irrespective of whether the unit is covered under ESIC.

If ESIC is applicable, maternity benefits will come from ESIC for all employees who are covered. For all other women employees, the employer is liable to pay maternity benefits.
