Facing Gratuity Claim Rejections: How Can We Legally Address This with WB Labour Commission?

Dear Team,

This question is regarding my spouse's job. She was attached to an ICSE-affiliated private school in West Bengal since 24th March 2010 and resigned on 6th May 2017. Her job included both PF and Gratuity benefits. However, every time she sends the Gratuity claim letter, the school authority refuses to accept it (sent by Registered Post and refused). In this case, how can we proceed legally, or is there a provision to lodge a complaint online with the WB Labour Commission? Kindly suggest how we should address this matter.

Please address the letter to the Controlling Authority under the Gratuity Act. The address should be the same as the one with jurisdiction in your wife's office area.

Filing a Complaint with the Gratuity Authority

In your case, you will need to file a complaint with the Gratuity Authority under the Payment of Gratuity Act. Mostly, the labor commissioner of the state is the authority, or any person nominated on his behalf is the Gratuity Authority under the Act.

Mention complete facts in the complaint, including the fact mentioned above. If you visited, mention the interactions with the school authority correctly. Request them to help you get the gratuity.
