Is EPF Deduction Mandatory for Employees Earning Above 15000? Seeking Legal Clarity

Sanjay Shandilya
In my manufacturing company, many employees are not ready to deduct the EPF portion, and the company is convincing not to deduct EPF for those employees whose salary is above 15000. Whenever I oppose this, they advise me to do so. Please confirm the legal obligation of EPF deduction.

Sanjay

If the employee has never been a member of EPF and is currently drawing basic + DA above 15000 PM, then it is up to the employee to accept or refuse the membership for EPF. However, the employer has to offer the same to all employees and has to get Form 11 signed from the employee for both contributing and refusing.

Once a person becomes contributory to EPF, they cannot be excluded in any case.

Dear Mr. Sanjay,

Please follow the practice of obtaining the "NEW FORM #11" - Declaration Form from all employees duly completed and signed by both the employee and the employer. You have to cover or exclude as per the information available in the Declaration Form.

Please peruse the attachment, which is self-explanatory.

Hi,

Form 11 is for our record purposes, or else we have to submit it to the PF office. Please advise.

Thanks & Regards,

Dear Mr. Suresh,

EPF Form #11 should be preserved by the employer for producing it at the time of EPF inspection.
