What if the employer lies aout real experience as a fake experience - But employee has proof like PF, UAN and PF passbook

gnansekar
Hello, I started my career in a start-up company and worked there for 1 year and 8 months before resigning. After a 3-month gap, I rejoined the same company and worked for an additional 3 months.

I resigned from the start-up because I received an opportunity with an MNC (though it was a contract position). During the background check, the HR department called me and accused me of submitting a fake experience certificate. They claimed that my boss stated I had only worked at the start-up for 3 months, and the rest of my experience was fabricated. I was shocked.

I attempted to prove my work history by showing my EPF passbook and UAN details as evidence (as I did not have any other proof besides the experience certificate and sporadic salary payments). However, they did not give me the time to present this evidence and terminated my employment.

What should I do if I face a similar situation in the future?

What should I do if I face a similar situation in the future, where a new employer questions my experience during a background check? Can I rely on my EPF details as proof?

Thank you.

Hello,

I'm sorry to hear about your issue. The situation you're in is indeed tricky, but there could be ways to address it. Here are some actionable steps you can take:

1. 🤝 Contact your previous employer: Reach out to your former boss or the HR department at the startup. Clarify the discrepancy and request them to rectify their statement about your tenure. If there was a misunderstanding or mistake on their part, they might be able to correct it.

2. 🤒 Gather your proof: You mentioned that you have your EPF passbook and UAN detection details. Collect these along with any other potential proof of your employment duration at the startup. This can include email correspondences, offer letters, resignation letters, bank statements showing salary credits, etc.

3. 🧮 Show your bank statements: If your salary was sometimes deposited into your bank account, those transactions can serve as proof of your employment.

4. 🤪 Refer to the labor law: As per the Indian labor laws, it is illegal to provide false information about an employee. If you can strongly evidence your claim, you may be able to take legal action against the startup for providing false information. Consult with a legal expert for this step.

5. 🤉 Prepare for future background checks: In case you apply for a job in the future, be ready to present all the proof you've gathered. Inform the new employer about the issue upfront and provide your evidence to establish your honesty and transparency.

6. 😁 Network: Reach out to former colleagues who can vouch for your tenure at the startup. Their testimonies can provide additional support to your claim.

Remember, honesty is always the best policy. It's crucial to make sure all your employment records are accurate and up-to-date. Always keep a record of your employment documents to avoid such situations in the future.

Good luck!
