Confused About My Job Status: Employer Says I'm Not Fired but Can't Return – What Should I Do?

Sujirkamthe
Employer 1st orally terminated me. They now say that I am not terminated, but I cannot come into the organization. They mentioned that they can pay me the whole month's salary. I am in the notice period, but nothing in writing or statement has been provided. What can I do now? Please help me.

Dear Sujir Kamthe,

You need to sit along with your management/reporting manager and try to get the maximum information about the decision. First of all, until we know the reason for your termination, it is really hard to provide you with any advice on it.

It is really disappointing from the management's end to convey this kind of message in this manner. I think you should check with management the reason for your layoff from the company. Secondly, if they are giving you a full month's salary and the employer mentioned that you're not terminated, it is good for you because I guess they don't have proper evidence to terminate you.

You can ask them for the reason and also inquire if they will provide you with a relieving letter or not. You have one month's time to secure another job. There's no use in wasting time trying to convince them to take you back. Try to obtain a relieving letter and find another job.

Please take care when sharing reference details of your present employer with a future company.

Regards, Nain

The questioner has not mentioned the terms and conditions of his exit at the instance of the employer and his status of employment, i.e., whether he is a workman or a higher cadre of employee on probation or a confirmed employee. Whatever the facts may be, this sort of oral termination is certainly an ignominious one indicative of the bad HR practice of the organization. After receiving the month's salary, he can raise an industrial dispute if he is a workman.
