Forced to Work Outside My Role and Then Fired: What Are My Legal Rights as an X-ray Technician?

Sujirkamthe
Hi, I am an X-ray technician in a hospital, but the employer forced me to work in the operating theatre. I refused to do so, and a dispute has been ongoing for several days. After my refusal, the employer terminated me and instructed me not to come on duty. I have not accepted the termination yet. What are my legal rights, and what can I do next? Please suggest.

If your statements are true, your termination is illegal as it lacks the procedural formalities required by an employer before terminating an employee on disciplinary grounds. You can raise a dispute under Section 2 A (1) of the Industrial Disputes Act, 1947, before the Conciliation Officer for your area. However, since what you have described appears to be an oral termination, it is crucial that you first write to the employer, detailing what has actually happened and your intention to seek legal remedy. Good luck.
