Is ESIC Registration Required for 14 Employees Earning Under 21K in Mumbai?

Hi,

We have 14 employees whose gross salary is under 21,000/- in Mumbai/Maharashtra. Do we need to get ourselves registered for ESIC? Is this mandatory for us?

Sir, kindly indicate whether the unit/establishment in question, for which you have raised the issue, is a factory engaged in manufacturing activities or if it is an establishment such as a shop, hotel, restaurant, etc. In other words, what specific activities are being carried out in the said unit within your establishment?

Please see the ESIC circular for coverage, which is for 10 or more employees and is dated 30-03-2011. This will help to clear any doubts.

ESI officials will look into the contract employees (though they are on other company rolls) like housekeeping staff, security, etc. If the total count crosses 20, then ESI becomes mandatory. Another point to note is that if the employee count is more than 20, but even if one person is below 21,000, then registration and payment of ESI become necessary.

You want to register or seek ways for exemption. It is better to register and comply with the growing organization, as this is a welfare legislation aimed at benefiting employees.
