Respected Sir/Madam,

Subject: Non-Receipt of Final Settlement Money (including last 7 days' salary)

My name is Pradipta Sen, and I left my last company, GeoTech Informatics Pvt Ltd, on June 7, 2013. Until today, I have been following up with them for my final settlement, which includes my last 7 days' salary totaling Rs. 58,000. Please assist me in recovering the mentioned amount. I have waited patiently for 4 years, giving my old company ample time with good faith and honesty.

The following are the supporting documents I have:

1. My release letter indicating my last working date
2. My bank salary statement displaying my last salary receipt date
3. An email regarding outstanding payment from GeoTech's Finance department
4. My follow-up email trail

Financial Condition and Intentions

1. What was the financial condition of the company when you left it? It has a strong bearing on their behavior. There can be mala fide intentions also to not pay or pay when they wish to pay.

Consulting an Advocate

2. I feel you need to consult a good and honest advocate who deals in service matters.

Legal Steps Under the Indian Companies Act

3. Some steps can be taken under the Indian Companies Act as well, but the advocate can provide better advice on the matter.

Time for Action

4. I admire your patience; you have waited for a long time. Now, the time for action starts as there are many companies who do not bother about the dues of their ex-employees.

Dear Sen,

The emails and letters you mentioned are more than sufficient to prove your claim. You should file a demand notice under registered cover stating all the facts to your employer and send a copy to the area Labour Officer/Inspector immediately for conciliation as the dispute is quite old.

Thank you for your suggestion to Mr. Gera and Mr. Sharma. Till now, I have already made a police complaint, and next, I am going to report all this to the labor department. Then we will see how they act.

@Bharat: The present condition of the company is not good, or they may pretend to do so.

I beg to differ from Mr. Saswata Banerjee. This is hard-earned money and cannot be left out for freeloaders. Ms. Pradipta Sen, please do not leave this money; employers will have to pay through their nose.
