Struggling to Claim My Late Wife's Bank Death Benefits: Any Relief from RBI?

vsksudars
Dear sir, My wife, who passed away in 2013, was the Manager of a leading Cooperative Bank. She died from breast cancer. We have no children. The bank has not settled the death claim benefits and other dues, stating that she had nominated her sister's daughters. To my knowledge, she did not leave a will. Her sister's daughters were staying with us, but I have spent all my earnings and time looking after her while she was ailing. The cancer had even affected her brain, and she was always restless.

All the hospital documents and corporation entries carry my name as the deceased husband. I have provided the bank with the original death certificate, passport copy, and other registered documents (which clearly state that I am her husband) to prove that I am her legal heir and entitled to the settlement.

Is there any relief from RBI? If so, please provide details and suggest remedies.

Thank you, sir.

Dear Mr. VSKDUDAR, your wife passed away while in service as a "Manager." You have not mentioned the date of death. Furthermore, you have not provided any information about the "Cooperative Bank," such as whether the bank is registered under the State Government, and if so, which state government.

What are the death claim benefits?

The question of whether there is a will to claim employment-related benefits does not arise. You should ask the bank to provide nomination details in the bank records for filing your objection. Is your marital status registered as "Husband" in the bank records?

Correspondence with the bank

From 2013 until the present date, what correspondence have you had with the bank? Why is there an inordinate delay from your end?

Gratuity and EPF benefits

Gratuity and EPF are payable to the husband, assuming you are not the nominee. Additionally, you are entitled to a pension under EPS.
