Stuck Between Jobs: How Can I Get My Resignation Confirmation from HR?

I have resigned from my previous organization on 2nd May 2017. I have received a resignation acceptance email with the last working date from my manager, but HR has not sent me a resignation acceptance email or last working date confirmation email. My new employer requires a resignation acceptance email or last working date confirmation email from the previous company's HR only. My new employer does not accept emails from my manager regarding the last working date. Neither the previous company's HR is sending a confirmation email as it goes against their policy, as HR mentioned, nor is the new employer accepting a confirmation email from my manager.

Kindly help me to resolve this issue. If there is any law related to this, please let me know. Kindly reply to this on priority.

Hi, I don't think it is a big issue. You only need a relieving letter from your last employer, which you can give to your current employer along with your resignation acceptance email to your manager. If your current employer asks for the resignation acceptance specifically for HR, then speak to the HR department of your last employer or their senior. A relieving letter or a salary slip should be sufficient proof to join a new company.

As per applicable labor laws, particularly in the Factories Act, only two designations are recognized, i.e., Factory Manager and Occupier. If your resignation is accepted by the Factory Manager, then there is no need to seek similar acceptance from your HR. Any clearance letter can also be arranged, which may be required at a new location.

Notice Period and Resignation Acceptance

What is the notice period as per the appointment letter? It is noted that you submitted your resignation on 02/05/2017, which has been accepted by your reporting manager but not by the "Appointing Authority" who issued the appointment letter to you.

Did you receive the appointment letter by mail? No, you were issued a hard copy duly signed. Complete your notice period as per the terms of appointment. You will be issued a relieving letter from the authorized person, which will address your concerns.

Have you fulfilled the notice period clause as per the law? If yes, you are entitled to a relieving letter.

Authority to Accept Resignation

Technically and legally, the appointing authority is the authorized officer or authority to accept a resignation. Your Head of Department (HoD) only has recommendatory powers to forward your resignation letter with his recommendations. He is not authorized to issue a 'Relieving Letter' (RL).

Obtaining the Relieving Letter

Your new company is correct in asking you to produce the RL from HR. I suggest you address any pending issues with your previous HR department to obtain the valid RL. This will allow you to join the new company and start a new career without any hindrance.
