Are Provident Fund and ESIC Required for Daily Wage Employees with Frequent Changes?

Please tell me, if a company hires employees on daily wages and there are changes in employees every day, are provident fund and ESIC applicable? Is it a requirement? Please reply.

Dear Member,

The Employees' Provident Fund and Miscellaneous Provisions Act, 1952, applies to concerns where you engage/employ 20 or more persons. Under Section 2(12), the ESIC Act is applicable to non-seasonal factories employing 10 or more persons. If you have registered your company, you must have a PF code and ESIC Code. Please ensure all your employees are covered under the social security Act and Scheme.

Why do you engage employees on daily wages? Is it in connection with your work? Are you changing employees every day? Why? Is your company already covered under ESI and EPF Act? Who pays salary to daily wagers? When you ask legal questions, please ensure to give all relevant details after the application of mind. Your question seems to be too casual.

Dear member, even if a person is employed for a day or a part of the day, he must be covered under the EPF & MPs Act, 1952 as well as under the ESI Act, 1948. There is no qualifying period for eligibility to become a member in the above Acts.
