Waiting for Final Settlement: Should I Take Legal Action or Be Patient?

Dear,

I left Damco Solution Pvt Ltd on December 13, 2016, after serving a 2-month notice period, and I have also received my release letter. However, the company has not cleared my Full and Final settlement (FNF) as of now. When I emailed them regarding this, they replied that it would be done by the end of August 2017.

Can anyone suggest whether I should seek legal help from the labor court against my previous company, or should I wait until the end of August 2017?

Please advise.

The full and final settlement of an employee has to be done within 30 days. August 2017 means eight months, which is a longer period. Going legal depends upon the amount of recovery from the employer and the time invested.

You have not given any information about your designation. If you were in a managerial position, then the labor court will not entertain your matter, and you will have to approach the civil court.

1. Nature of your job.
2. Nature of the company with strength.
3. Date of appointment.
4. Date of resignation.
5. Last drawn wages.
6. Components of your full and final settlement.

You can wait until the end of August as mentioned in your previous concern. If things do not work out, then you can consider taking legal steps.

You have not furnished reasons for non-settlement of your dues. There is no point in waiting. Please furnish all relevant details pertaining to your pending dues for future course of action. Take the help of any literate person and work out components of dues.
