Stuck Without an Appointment Letter or Promised Salary: How Can I Resolve This?

Dear all, I worked in a small startup Pvt. Ltd for 2 years. Despite repeatedly asking for an appointment letter, they have not provided one. I resigned last month and have pending salary as they did not give me the promised amount. When I asked for both, they claimed there is no signed paper for the promised salary, so there is no pending salary. They also refuse to provide the appointment letter since I have already resigned. They are asking for a simple resignation letter because the letter I sent contained a mention of my pending salary, and they are withholding my final month's salary as well.

Do you have any advice or suggestions to help me in this situation?

If you have any document given to you by your company, please share to appropriately advise. Were they paying salary in cash or in your bank account directly through bank transfer? Were you covered under ESI, PF?

You must have:

1. Pay slip showing details of Salary.
2. Anything in writing from your side to HR Dept. for correct Salary.
3. Any other communication in writing.
4. ID card.
5. P.F, ESIC.

It is a fact that you have worked with the company. As such, the lack of an appointment letter need not affect the status of your past employment or the salary that is pending. However, the question of the salary promised depends upon the evidence you can muster.

There is no harm in submitting a revised resignation letter if the same has been sought in writing.
