Stuck in a Job: How to Handle False Data Theft Allegations and a Rejected Resignation?

Respected Sir/Madam,

I have been working with a company for the last 10 months, and then I got a better opportunity with another organization. Due to my career growth, I resigned from my current organization with a 30-day notice period. However, our HR and General Manager declined my resignation by replying "Not Accepted." I want to mention that I am a professional VBA developer, and my senior does not have any concerns against me.

During the reference check by my future employer, my current employer alleged that I stole data from the office premises and refused to release me. Consequently, my future company decided not to accept me.

Please suggest what steps I should take in this scenario.

Simply contact an advocate and do the following:

1) File an FIR under IPC on charges of defamation, Criminal Intimidation, Cheating, and Using tampered documents to aid cheating.

2) File a civil suit under the tort of defamation, malicious prosecution, and wrongful hurt.

3) Draft a complaint and lodge it with the Central Labour Commissioner and send a copy to the Labour Ministry.

If your assertions are true, you will be fairly compensated.

The suggestion given to you is good. However, keeping future career growth in mind, take the next step. Normally, organizations don't entertain candidates who complain in the labour court or any other authority. There are other ways to solve the issue. Follow the rule in mythology - Sama, Dana, Bheda, Danda.

The facts, as posted, constitute a cause of action for civil and criminal action. However, the queriest has the option of serving a Legal Notice as the preliminary step. Perhaps, the Notice itself may settle the issues.
