Can I Resign with Two Weeks' Notice If My Confirmation Letter Is Delayed?

I have been working with this company for 6 months. To date, no confirmation letter has been issued by HR, even though they load me with tons of work. If I am still not confirmed, can I tender my resignation within a 2-week period?

Confirmation Letter Signing Process

Another question: In any company that issues a confirmation letter to its employees, as I understand it, both parties must sign the confirmation letter, right? Employer and Employee. Is the confirmation letter valid if the employer purposely backdated the letter and issued it to the employee, stating that I am a confirmed staff after I tendered the resignation letter? Because once I am confirmed, there will be a one-month notice period.

If you have a good opportunity or have decided to leave the organization, you can tender your resignation stating that since you are not confirmed as of the date of resignation, the notice period as per the appointment letter/terms will be two weeks.

Signing of Confirmation Letters

Signing by both parties on the confirmation letter is not mandatory. However, the company may sign backdatedly to confirm that the confirmation was issued to you long ago. In such instances, the company must provide evidence that the letter was indeed issued to you or that you received it. If such confirmation is unavailable, you can argue that the letter was never issued to you.

Resignation During Probationary Period

As you are in a probationary period, you can resign following the notice period specified in your offer letter (assuming you have one). If needed, you can seek assistance from a professional to draft your resignation letter.
