HR Compliance To Start Our Business In Our New Office In Bengaluru

gayathri@phykon.com
Hi All,

I am an HR executive in an ITES organization in Kerala. We have taken a 50-seater space in Bengaluru. My query is - what legal compliance should be followed to start a business in our new office space in Bengaluru?

Ms. Gayatri,

You must be covered under the Shop & Establishment Act.

Download the Statutory Compliance document to access all the necessary information.

Hi Gayathri,

You will have to take registration under the Karnataka Shops and Commercial Establishment Act, acquire Professional Tax Registration, and, of course, obtain the EISC sub-code.

You have to get registration for the following:

1) Shops & Establishments
2) ESIC if applicable
3) PF if applicable
4) Professional Tax if applicable
5) Service Tax registration

Hi, Gayathri. You need to avail the following registrations:

- Shops & Commercial establishment certificate
- EPF is not mandatory as it may be covered from the head office
- ESI subcode is required
- Professional tax registration
- Trade license from BBMP

If it is purely service-oriented, then no need for Sales tax registration. However, you may have to update the service tax registration as multi-location at your head office range.

Thank you, Mr. Jeevarathnam.

We have completed the initial recruitment process, and all the candidates have been offered a gross salary of more than INR 21,000. In this scenario, should we register for ESI under a sub-code? Is that a mandatory requirement?

Gayathri

Ms. Gayatri,

If you are offering a salary higher than the ESIC limit, it is not necessary. In the event you believe that any other category may be covered under this Act, it is advisable for future cases.

Even if there is any one employee who is earning gross pay of less than Rs. 21,000/-, then it is mandatory. How about security/housekeeping?

There are cases where ESI officials forced organizations to register with ESI even if there is no employee drawing less than the ceiling limit.

If we have only 15 employees, do we need to register for ESIC or for gratuity if employees' salaries would be above the limit? Will gratuity be applicable to us?
jeevarathnam
Gratuity is applicable for all employees if the organization has employed more than 10 employees in a calendar year.

ESI is applicable only for employees who earn wages of 21,000/- or less.

Dear Ms. Gayathri,

Please check whether the 3rd party agency has enrolled in ESIC. If not, you will be liable.
